1. Categories of Membership The MBC shall comprise the following categories of membership:

Ordinary Corporate Membership: companies, corporations and organizations in good standing which are incorporated in or established under the laws of Malaysia (herein referred as “Malaysian-registered companies”), and which have a legal presence in Vietnam in a form permitted by the laws of Vietnam. Ordinary Corporate Membership can nominate up to three (03) representatives from their Organization to represent them as Members and each of such Members shall have the same voting rights as an Ordinary Individual Member, subject to complying with Article 6 (h) & (i) Rights & Duties of Members. -
Ordinary Individual Members: citizens and permanent residents of Malaysia, aged 18 years and above, who are in good standing and interested in business, trade, investment and/or other permitted activities in Vietnam, and are ordinarily residents in Vietnam. -
Associate Members: open for membership to any one (Non-Malaysian) in good standing working in Vietnam under Malaysian or non- Malaysian companies. -
Spouse Members: open to spouse of all categories of Members. All categories of membership are not transferable except Ordinary Corporate Membership which may change their representative(s) who has left their Organization. Companies and individuals may apply for membership and acceptance shall be determined by the Executive Committee. No reason needs to be given in the event of a rejection. Application for Membership -
Application for membership shall be made on the form prescribed for such purpose by the Executive Committee and shall be submitted to the Association or to any of the Executive Committee members. -
The Executive Committee shall vet and determine all applications for membership. No reason need be given to any candidate for membership whose application is rejected although a written appeal can be made to the Executive Committee. The decision of the Executive Committee on such appeals shall be final and binding. 3. Resignation from Membership -
Any Member desiring to resign from membership must deliver written notice of resignation to the office address of the MBC or through any of the Executive Committee members. -
Every resignation notice shall be deemed to take effect on the date stated in the notice, or on the date that such notice is received by the MBC, whichever is later. 4. Expulsion The Executive Committee may, by notice in writing, exercise the right at any time to expel any Member if, in the opinion of the Executive Committee: -
Such Member has breached the constitution of MBC; -
Such Member has conducted himself in an unbecoming manner detrimental to MBC’s interest and image; -
Allowing such Member to remain as a Member would bring discredit to MBC. A Member may appeal to the Executive Committee against such decision within 30 days of receiving such notice. The Executive Committee shall consider such appeal and its decision shall be final and binding on the Member. 5. Termination of Membership Membership will be terminated if a Member: -
Dies; -
Resigns; -
Is declared bankrupt by a court of competent jurisdiction; -
Ceases to qualify for membership under his category of membership; -
Is expelled under Article 5 (4) above; -
Is in areas of payment of any fees (as defined in the Article 7 (11) or of any other additional contributions and charges) required to be paid to MBC; -
Is declared by a court of competent jurisdiction to be legally or mentally incompetent. Each Member shall, on termination of its membership with MBC for whatever reason, forfeit all rights to any claims upon MBC, including all its properties and funds.
